The laws on regular assessments

Article 16 (The frequency, process, and methods of regular assessments or relocation assessments), the Enforcement Rules for the Industrial Standardization Act
  • ① A person that has been certified shall, from the date of issuance of the certificate as per Item 1, Article 19 of the law, receive regular assessments within the dates indicated in each of the following paragraphs in the form of factory inspection. For their services, the person shall receive a business facility assessment and service assessment.
    1. The frequency of the regular assessments of the certified products as per Item 1, Article 15 of the law shall be as per each of the following paragraphs;
    1. A. The items subject to yearly factory inspections as per Table 12: yearly. However, if the factory passes a regular assessment, the immediately following regular assessment can be exempted.
    2. B. Products other than Paragraph A: Every three years
    2. The frequency of the regular assessment of the certification service as per Item 1 under Article 16 of the law shall be in accordance with the following paragraphs;
    1. A. The services included in an announcement by the head of the administrative agency based on the decision that the quality of the service is compromised: every year. However, if the service passed regular assessments for two times in a row, the immediately following regular service assessment can be exempted.
    2. B. Services other than Paragraph A: every two years
  • ② Despite Item 1 above, if a certified person moves her production facilities, business facilities, or the facilities where the certified services are provided to another location, she must receive a relocation assessment in accordance with Item 2, Article 19 of the law within 45 days from the said relocation. In such a case, it is required to submit a relocation assessment request as per Form No. 14 within 10 days from the completion of the relocation of the said factory or facility to the certification body that issued the original certificate.
  • ③ After passing the relocation assessment as per Item 2 above, it shall be considered that the facility/factory passed a regular assessment as per Item 1. And, the subsequent regular assessments shall be performed as per the frequency in the applicable paragraph under Item 1, starting from the date of relocation assessment.
  • ④ Despite Item 1, the first regular assessment after any of the following events shall be exempted. For services in such a case, the service assessment, which is a part of the regular assessment, shall be exempted.
    1. A person that receives an Industrial Medal or an industrial citation according to the AWARDS AND DECORATIONS ACT;
    2. A person that received a citation from the President or the Prime Minister according to the 'Government Citations Rules' regarding industrial standardization or innovations in quality management; and,
    3. A person who received a citation from a head of a central administrative agency and recognized by the head of the administrative body of jurisdiction for industrial standardization and innovations in quality management.
  • ⑤ If a certified person wishes to receive a regular assessment as per Item 1, she must submit a regular assessment request form as per Form No. 14 to the certification body of the original certification.
  • ⑥ The process and method of the regular assessment in Item 1 and relocation assessment in Item 2 are governed by Article 14.
  • ⑦ The head of the administrative body of jurisdiction shall make an announcement of the details regarding the processes and methods of regular assessment in Item 1 and relocation assessment in Item 2.
Article 38 (Regular Assessment), KS Certification Operation Guideline
  • ① The certified person shall, within the time frame specified in Article 16 of the rules from the date of certification, receive the factory inspection as per Item 1, business facility inspection in Item 3, and service assessment in Item 4 in Table 9. However, if the items or service categories requiring regular assessments come to belong to different periods, the regular assessment request can be made for the item that occurs the earliest while covering the rest of the items of the different periods at the same time.
  • ② The certification body may if the certified person received a three-year regular assessment, exempt one-year factory inspection of the same year of the date of the said regular assessment.
  • ③ As per Item 2, if the yearly factory inspection has been waived, the yearly factory inspection of the year that follows the year of three-year regular assessment shall not be waived.
  • ④ The certification body shall be entitled to demand corrections of any non-conformities as per Article 13 of the Rules as a result of the regular assessment Article 16 of the Rules.
  • ⑤ The certification body shall, if the regular assessment confirms conformity, reissue the certificate as per Article 26, indicating the time of the next regular assessment, which shall be within three years for product certification and two years for service certification. However, no certificate shall be issued for yearly factory inspections.

  • ① The certified person must be assessed within the time frame for a regular assessment from the date of certification. However, if the items or service categories requiring regular assessments come to belong to different periods, the regular assessment request can be made for the item that occurs the earliest while covering the rest of the items of the different periods at the same time.
  • ② The certification body, if the certified person received a three-year regular assessment, waivers a one-year factory inspection of the same year of the date of the said regular assessment.

  • A factory inspection shall cover 33 evaluation items, and the result is given as either a pass or a fail.
    * The quality management items will be skipped if the applicant is an ISO-9001 certified company for the items of application.
  • Of the evaluation items, the key quality items are the confirmatory assessment evaluation items, while the rest are the general quality items that are subject to improvement evaluation.
  • During a regular assessment, the non-conformities with the key quality items shall result in the suspension of production and sales.
